These Terms of Service are the Terms & Conditions of use for Topper (topper.app). They are a product-based contract between you and the operator of the Topper brand. They are not a substitute for independent legal advice. By using Topper you accept the whole contract, including the release, indemnity, and limitation of liability below, the Privacy Policy, and the Disclaimer. If you do not accept that allocation of risk, do not use Topper.
1. Acceptance
You may browse live sports, boards, and public pages as a guest. Guest browsing does not create an account and does not let you place predictions, create a party, or join a party.
The first time you predict, create a party, or join a party, we ask you to verify a phone number, confirm that you are 18 or older, and accept these Terms and the Privacy Policy. If you do not accept, you cannot finish setup.
2. Who we are
Topper is operated as the brand Topper at topper.app. There is no separate registered company name in this contract. Contact for these Terms, privacy requests, and other notices: ops@topper.app.
3. Eligibility
- You must be 18 or older. We collect a date of birth at signup and lock it after you set it. We do not verify government ID.
- One phone number may have one Topper account. Multi-accounting to game leaderboards is a breach of these Terms.
- Topper is available worldwide. You alone decide whether your country, state, or city lets you use a no-money social prediction game. If it does not, you must not use Topper. We do not give legal advice on that question.
- Topper is not directed at children. If we learn an account belongs to someone under 18, we will close it.
4. What Topper is — and is not
Topper is a free sports prediction playground. You read live market odds, pick For or Against (and Over or Under on Quickies), and compete with friends and other fans on leaderboards and in parties. The prize is a better read — bragging rights, not cash.
Topper is not a bookmaker, casino, payment service, or real-money gaming operator. We do not take deposits or withdrawals. We do not offer prizes, goods, or services in exchange for points. We do not place or accept real-money wagers. We do not embed live streams. Nothing on Topper is an offer to gamble, a tip, or a representation that the product is lawful for you.
The product is labelled BETA. Features, odds availability, and boards may change, pause, or break.
5. Match Points, leaderboards, and parties
Each match gives registered players a Match Points wallet to use on predictions for that match. Those points have zero monetary value. They cannot be bought, sold, gifted, transferred, redeemed, or exchanged for cash, prizes, goods, services, or anything else — inside or outside Topper, between users or otherwise. There is no code path that credits points in exchange for money. There never will be a pack, top-up, or pass that buys points or a competitive advantage.
Cheers (emoji taps during a match) may add a small bonus to a match wallet, capped so they cannot dominate the pot. Leaderboards rank predictions. Parties are friend groups you create or join with an invite code. None of this converts points into value outside the game.
6. Predictions and settlement
Odds come from a third-party sports exchange. We read them only. We do not operate that exchange and we do not send orders to it. Scoreboard figures come from a separate third-party source and are not used as a warranty of the result.
A market may suspend, void, abandon, or resettle if the feed drops, a result is corrected, or we find an error. Your match wallet and leaderboard rank can change after those corrections. We may refuse or reverse a prediction that looks abusive, duplicated, or placed against stale or broken odds.
7. Acceptable use and anti-solicitation
You will not use Topper to arrange, solicit, advertise, or settle real-money side bets, wagers, or cash games — in chat, parties, handles, share text, or anywhere else on the service. That is a first-strike bannable offence. If you do it, every civil and criminal consequence is yours. Topper is not your counterparty, agent, or book.
You will not harass others, post illegal content, scrape the service in a way that harms it, impersonate Topper, attack the feed or leaderboards, or use automation to place predictions or farm ranks. We may hide, shadow, or close accounts that break these rules.
8. Your content
You keep whatever rights you have in your handle, display name, party names, and messages. You grant Topper a worldwide, royalty-free licence to host, display, and share that content as needed to run the product (boards, parties, invites, leaderboards).
Avatars are chosen from Giphy, not uploaded by you. Giphy’s terms and licence apply to those GIFs. Do not pick an avatar you are not allowed to use.
If you delete your account we release your handle, remove you from parties, and reattribute predictions and ledger rows to “Deleted user” so ranks stay honest. Chat, when it ships, is reattributed the same way.
9. Third-party data and BETA
Odds, scores, team names, and kick-off times can be late, wrong, or missing. See the Disclaimer. Composite voices on the homepage are examples, not verified reviews.
10. Suspension and closing accounts
We may suspend or close an account for breach of these Terms, multi-accounting, solicitation, abuse, or to protect the integrity of leaderboards. You may ask us to delete your account by writing to ops@topper.app. Deletion follows the path in the Privacy Policy: personal details are removed; prediction history stays as “Deleted user”.
11. Your risk, your law
You use Topper entirely at your own risk. You are solely responsible for knowing and obeying every civil and criminal law that applies to you — including gaming, gambling, public-order, telecom, and data laws where you live or where you open the app. If using Topper would be unlawful for you, you must leave immediately.
Any civil claim, criminal charge, investigation, fine, penalty, seizure, or regulatory action that arises from your use — or from anyone you invite, share with, or play against — is yours alone. Topper does not advise you, represent you, or stand in your place before any court, police, or regulator.
12. Release from civil claims
To the fullest extent Indian law and any other applicable law allow, you irrevocably release and forever discharge Topper, the Topper brand operator, and anyone acting for us (together, “Released Parties”) from every civil claim, demand, cause of action, damage, loss, cost, and expense of any kind — whether in contract, tort (including negligence), equity, statute, or otherwise — that arises out of or relates to Topper, these Terms, Match Points, odds, scores, settlement, parties, chat, leaderboards, account action, downtime, or any third-party feed or processor.
That release covers claims you know about and claims you do not, claims that exist now and claims that arise later, and claims brought by you or by anyone claiming through you. You will not sue, join, or assist a civil action against a Released Party for those matters except to the extent a statute says you cannot give up that right.
13. No liability for civil or criminal acts
A website contract cannot cancel a criminal statute. These Terms do not licence an offence and do not say Topper is above the law. They do say this: Released Parties are not responsible for any civil or criminal act, omission, or consequence of yours, of another user, or of any third party. That includes real-money side bets arranged off-platform, harassment, fraud, multi-accounting, scraping, or any use of Topper that a prosecutor or claimant later calls unlawful.
You will not treat Topper as a principal, agent, bookmaker, conspirator, or aider in anything you or others do with or around the product. If a court, police service, or regulator asks about your account, we may cooperate as law requires. That cooperation is not an admission of fault.
14. Indemnity
You will defend, indemnify, and hold harmless the Released Parties from every claim, demand, investigation, proceeding, loss, damage, fine, penalty, settlement, judgment, and reasonable cost (including legal fees) that arises from: your use or misuse of Topper; your content; your breach of these Terms; your violation of any civil or criminal law; any real-money arrangement you make; or any claim by a third party that your conduct caused them harm.
We may take over the defence of a claim you must indemnify. You will cooperate. You will not settle a claim that names a Released Party without our written consent.
15. Disclaimer of warranties and cap on liability
Topper is provided as-is and as-available, with no warranty of any kind, express or implied — including merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement. Odds, scores, names, and times can be wrong. The product is BETA and may stop without notice.
To the fullest extent law allows, Released Parties are not liable for any indirect, incidental, special, consequential, exemplary, or punitive loss, or for lost rank, lost points, lost data, lost opportunity, reputational harm, or any claimed value of Match Points (which is zero). We are not liable for third-party feeds, SMS delivery, hosting, or GIF libraries.
If, despite the release above, a Released Party is found liable to you, that liability is capped at the amount you paid us for Topper in the twelve months before the claim — which is zero — or one hundred Indian rupees, whichever a court will enforce, and never more. You agree that this cap is a genuine allocation of risk for a free product.
Nothing in these Terms excludes liability that applicable law does not let a person exclude — typically fraud, or death or personal injury caused by negligence, where that bar exists. Those exceptions are as narrow as the statute writes them. They do not reopen a general duty to keep you entertained, ranked, or on the right side of your local gaming law.
16. Changes
We may change Topper or these Terms. The effective date at the top of this page will update. Continued use after a change is acceptance of the new Terms. If a change is material we will try to say so in the product. Check this page when you sign in.
17. Governing law
These Terms are governed by the laws of India. Courts in India have exclusive jurisdiction over any dispute, except that you may have mandatory consumer protections in your home country that we cannot take away. You waive any inconvenient-forum objection to those courts to the extent law allows.
